Sportsbet Aussie Rules & Rugby League Footy Tipping Competition Terms & Conditions of Entry
1. Information on how to enter and prizes forms part of these Terms & Conditions of Entry. These Terms and Conditions of Entry serve as separate Terms and Conditions of Entry for the Competitions being conducted for each of the Codes referred to herein where such a Competition is being conducted by Sportsbet on the Sportsbet Northern Territory Web Site. Entry into the Competition is deemed to be an acknowledgement of these Terms and Conditions of Entry. Entries not complying with these Terms & Conditions of Entry are ineligible and Sportsbet reserves its absolute right to disqualify any Sportsbet Customer or Group from the Competition if any entries do not comply with these Terms & Conditions of Entry.
2. The competition is conducted on the Sportsbet Northern Territory website and is only open to current members of Sportsbet who have current customer accounts with Sportsbet (“Sportsbet Customer”) and who have satisfied all standard Sportsbet regulatory identification requirements. The competition is to be free of charge to Sportsbet Customers.
3. In these Terms & Conditions of Entry, unless the contrary intention appears, the following words and phrases have the meanings set out opposite them:
Accumulative Margin" means the sum of the Margin Differences for all Rounds to date for a Registered Participant. Registered Participants with a lower Accumulative Margin will be ranked higher than those with higher margin Accumulative Margins subject to conditions 11, 12 13, 14, 17 and 18;
Away Team” means the team that is listed by the sporting code as playing away from their home ground. If the Code does not nominate an Away Team, the Away Team will be nominated at the discretion of Sportsbet.
“Cash Deposit” means an equivalent amount of value accredited to a Registered Participant’s Sportsbet account which may be withdrawn from the Registered Participant’s Sportsbet account in exchange for cash at the election of the Registered Participant unconditionally.
"Code" means the series of Matches of – a) National Rugby League conducted by the National Rugby League (NRL) between member teams of the NRL over the NRL Season; or
b) Australian Rules Football conducted by the Australian Football League (AFL) between member teams of the AFL over the AFL Season; or
"Competition" means Sportsbet Footy Tipping Competition whereby winning entries are based on the Results of Matches at the conclusion of the relevant Code's Season;
"Group" means a group of 2 or more Sportsbet Customers who have entered the Competition under a collective registration and who may, by using the tipping results of thoseSportsbet Customers, conduct a separate non-commercial competition, the winner or winners of which may be eligible for prizes offered by the Group’s Manager or other provider and which do not form part of the prizes offered by Sportsbet in this Competition;
"Margin Difference" means the number of points between the margin entered by the Registered Participant for the team they tip to win and the actual margin for the round. The Margin Difference will be calculated depending whether the Registered Participant has tipped the winning team for the Margin Game. If the Registered Participant has tipped the winning team for the Margin Game, the Margin Difference will equal the difference between the actual margin and the margin entered by the Registered Participant. If the Registered Participant tipped the losing team the Margin Difference will equal the actual margin plus the margin entered by the Registered Participant. Registered Participants with a lower Margin Difference will be ranked higher than those with a higher Margin Difference subject to conditions 11, 12 13, 14, 17 and 18;
"Margin Game" means the difference between the score of the winning and losing team for a Match;
"Match" means a single game, of and conducted by the relevant Code, between member teams of that Code;
"Northern Territory Web Site" means the Web Site of Sportsbet at www.sportsbet.com.au/tipping accessible on the Internet through the World Wide Web as regulated by the Northern Territory Racing Commission in accordance with Sportsbet’s license to conduct business as a Sports Bookmaker under the Northern Territory Racing and Betting Act.
“End of Season Prizes” shall mean a cumulative total of $450,000 of Cash Deposits issued to select winning Registered Participants per Code for the entire season. End of Season Cash Deposits amounts will be issued for each Code as follows:
Place 1 - $250,000 Cash Deposit
Place 2 - $100,000 Cash Deposit
Place 3 - $50,000 Cash Deposit
Place 4 - $25,000 Cash Deposit
Place 5 - $10,000 Cash Deposit
Place 6 - $5,000 Cash Deposit
Place 7 - $4,000 Cash Deposit
Place 8 - $3,000 Cash Deposit
Place 9 - $2,000 Cash Deposit
Place 10 - $1,000 Cash Deposit
Place 1 to 100 (“End of Season Runner-Up Prizes”) – 200 general admission tickets to the 2008 Grand Final valued at approximately $250 each or in the event that tickets are not available the equivalent monetary value. 2 tickets will be allocated to each of the top 100 Registered Participants in each Code.
“Monthly Prizes” shall mean a cumulative total of $4,050 of cash deposits issued to select Registered Participants per Code across 6 months for the entire season. Monthly cash deposits amounts will be issued for each Code as follows:
Place 1 - $300 Cash Deposit
Place 2 - $200 Cash Deposit
Place 3 - $100 Cash Deposit
Place 4 - $50 Cash Deposit
Place 5 – $25 Cash Deposit
“Registered Participant" means a person who is eligible to participate in the Competition;
"Results" are the results of Matches as officially determined by the relevant Code in accordance with the rules of that Code following the completion of a Round;
"Round" means a round of matches of the relevant Code conducted during that Code's Season;
"Score" means the allocation of points to a Registered Participant for the correct selection of winning teams;
“Season” means the 2008 season of a relevant Code;
“Sportsbet” means Sportsbet Pty Ltd, an Australian company with a registered office in the Northern Territory of Australia (ABN 87 088 326 612) and licensed to conduct the business of a Sports Bookmaker by the Northern Territory under the Racing & Betting Act NT 1993.
4. The Competition is open to Sportsbet Customers who have satisfied the requirements of the Sportsbet Membership Rules. Employees of Sportsbet and its agencies associated with this Competition and their immediate families are ineligible to enter. Entry into the Competition is free.
5. Entry into the Competition is available for the following Codes, if applicable:
a) from 1/2/08 and closes on 7/09/08 for the NRL Code;
b) from 1/2/08 and closes on 31/08/08 for the AFL Code;
6. To enter the Competition for a particular Code, a Participant must:
a) be a registered member of Sportsbet;
b) become a registered member of Sportsbet by registering their details via the on-line registration form on the Sportsbet Web Site at www.sportsbet.com.au/signup and satisfy the Sportsbet Membership Rules;
c) register their details via the on-line registration form using their existing Sportsbet account located on the Sportsbet Web Site at www.sportsbet.com.au/tippingregistration;
d) for each Round, make a selection of the teams the Sportsbet Customer tips to win and the margins by which they expect the winning teams’ scores to exceed the losing teams and submit that entry via the Sportsbet Northern Territory Web Site in the manner and within the time frames set out on the Sportsbet Web Site. A draw cannot be selected as a Match selection.
7. A Sportsbet Customer may register their own personal details as per condition 6c) for participation in the Competition. Sportsbet however reserves the right not to accept for registration or allow any such registration to continue, any Sportsbet Customer if the registration contains anything defamatory or is otherwise offensive in any way.
8. Once a Sportsbet Customer becomes a Registered Participant that person will be allocated one point towards their Score for each correct selection of a winning team. Registered Participants will be ranked by their Score, where the highest Score is the highest rank. In the event of a Match in a given Round being drawn, cancelled, abandoned, not completed or not played for any reason and/or a Result is not officially declared within three (3) days of the date the Match was originally schedule to be played, it is treated as a win for both teams competing in that Match.
9. A Registered Participant may make or change a selection of the team the Registered Participant tips to win for a given Match in a Round at any time prior to the scheduled starting time of that Match.
10. If a Registered Participant:
a) does not submit an entry for a given Match in a Round, then the Registered Participant's tip for that Match will be deemed to be for that of the team determined to be the "away team";
b) does not submit an entry into the Competition for a given Round, the Registered Participant's tips for that Round will be deemed to be those of the teams determined to be the "away teams" to a maximum of five correct tips for that Round;
c) enters the Competition after the commencement of the first Round, then the Registered Participants tips for those Rounds that have been completed will be deemed to be those of the teams determined to be the "away teams" to a maximum of five correct tips for each such Round.
d). does not submit an entry into the Competition for a given Match in a Round, and that Match is a Margin Game, the margin tipped for that particular Margin Game will be by default zero (0). 11. Weekly Place winners will be determined by the Registered Participant's Score for that Round and then by their Margin Difference for the same Round and then by their Accumulative Margin. Where Registered Participants have identical Scores, the Registered Participant with a lower Margin Difference will be ranked higher than those with a higher Margin Difference. Where the Registered Participants have identical Scores and identical Margin Differences the Registered Participant with a lower Accumulative Margin will be ranked higher than those with a higher Accumulative Margin.
12. Monthly Place winners will be determined by the Registered Participant's combined Score for all Rounds played in a particular calendar month (with exception for the NRL Code Round 26 which will be included in the August 2008 monthly prize) then by their Margin Difference for the same combined Rounds played in a particular calendar month and then by their Accumulative Margin. Where Registered Participants have identical Scores, the Registered Participant with a lower Margin Difference will be ranked higher than those with a higher Margin Difference. Where the Registered Participants have identical Scores and identical Margin Differences the Registered Participant with a lower Accumulative Margin will be ranked higher than those with a higher Accumulative Margin. Monthly Prizes and their values (if any) for end of season place winners are as set out on the Web Site for the relevant Code. Monthly prizes will be allocated to applicable Registered Participants on the first day of the following applicable calendar month with exception for the NRL Code August 2008 monthly prize which shall be awarded on 8 September 2008 following the conclusion of Round 26 of the NRL.
13. The ranking of end of season place winners for each Code will be determined by their total Score for all Rounds and then by their Accumulative Margin. Subject to condition 17 where Registered Participants have identical Scores and identical Accumulative Margins the Participant with the lowest weekly Margin Difference for the final Round will be ranked highest. End of Season Prizes and their values (if any) for end of season place winners for each Code are set out on the Web Site for the relevant Code. Therefore:
a) the Registered Participant(s) with the highest rank will be considered the first place winner; and
b) the Registered Participant(s) with the second highest rank will be considered the second place winner; and
c) the Registered Participant(s) with the third highest rank will be considered the third place winner; and
d) the Registered Participant(s) with the fourth highest rank will be considered the fourth place winner; and
e) the Registered Participant(s) with the fifth highest rank will be considered the fifth place winner; and
f) the Registered Participant(s) with the sixth highest rank will be considered the sixth place winner; and
g) the Registered Participant(s) with the seventh highest rank will be considered the seventh place winner; and
h) the Registered Participant(s) with the eighth highest rank will be considered the eighth place winner; and
i) the Registered Participant(s) with the ninth highest rank will be considered the ninth place winner; and
j) the Registered Participant(s) with the tenth highest rank will be considered the tenth place winner; and
k) the first one hundred Registered Participants with the highest rank will be eligible for End of Season Runner-Up Prizes. Where a Registered Participant(s) with the lowest rank out of the top one hundred Registered Participants have identical Scores and identical Accumulative Margins the Participant with the lowest weekly Margin Difference for the final Round will be ranked highest. End of Season Runner-Up Prizes and their values (if any) for end of season place winners are as set out on the Sportsbet Web Site for the relevant Code.
14. The ranking of monthly place winners for each Code will be determined by their combined total Score for all Rounds that begin during the respective calendar month and then by their Accumulative Margin. Subject to condition 17 where Registered Participants have identical Scores and identical Accumulative Margins the Participant with the lowest weekly Margin Difference for the final Round of the calendar month will be ranked highest. Monthly Prizes and their values (if any) for end of season place winners for each Code are set out on the Web Site for the relevant Code. Therefore:
a) the Registered Participant(s) with the highest rank will be considered the first place winner; and
b) the Registered Participant(s) with the second highest rank will be considered the second place winner; and
c) the Registered Participant(s) with the third highest rank will be considered the third place winner; and
d) the Registered Participant(s) with the fourth highest rank will be considered the fourth place winner; and
e) the Registered Participant(s) with the fifth highest rank will be considered the fifth place winner; and
15. End of season place winners will be determined on the dates and times listed below for the relevant Code, if applicable:
a) 1/10/08 for the NRL Code; b) 24/09/08 for the AFL Code;
16. In the event of a draw or cessation or cancellation of the Code Competition then the Rules as applied by the Code will govern the result for this Competition.
17. Subject to conditions 13 and 14, in the event that:
a) two Registered Participants have an equal highest rank, then the first place prize will be combined with the second place prize and the resulting amount will be shared equally between those Registered Participants. The third place prize will then be won by the Registered Participant with the second highest rank (and where two or more Registered Participants have an equal second highest rank, then the third place prize will be shared equally amongst those Registered Participants);
b) more than two Registered Participants have an equal highest rank, then the first, second and third places will be combined and the resulting amount will be shared equally between those Registered Participants;
c) the first place prize is won by one Registered Participant only and two or more Registered Participants have an equal second highest rank, then the second place prize will be combined with the third place prize and the resulting amount will be shared equally between those Registered Participants;
d) a place winning Registered Participant is unable to accept a prize for whatever reason, Sportsbet will award that prize to the Registered Participant or Registered Participants who would have met the eligibility criteria and been deemed the place winner or winners had the place winning Registered Participant not participated in the Competition.
18. If a end of season place winning prize is a non-monetary prize (and had it been a monetary prize it would have been shared by more than one Registered Participant as provided for in condition 13 then all of those Registered Participants which would have shared the monetary prize will also receive the non-monetary prize if available, alternatively the monetary equivalent of that non-monetary prize value will be allocated to those particular Registered Participants. Monthly Prizes and End of Season Prizes and their values (if any) for monthly and end of season place winners are as set out on the Northern Territory Web Site for the relevant Code.
19. Sportsbet and its agencies associated with this Competition are not liable and do not accept responsibility for:
a) a Registered Participant's tips that are not received or which are received and subsequently corrupted or rejected by the Northern Territory Web Site server, whether submitted by the Registered Participant or by an administrator if in respect of a Group participation. This explicitly includes any private or public tipping competition which use in any way or solely rely on the Northern Territory Web Site as a means for collection and disbursement of data to their Registered Participants;
b) any lost, misdirected or corrupt emails to or from the Northern Territory Web Site;
c) any loss or damage whatsoever (including but not limited to direct or consequential loss) or personal injury suffered or sustained:
(i) in connection with a Registered Participants participation in the Competition or the taking of a place, except that which cannot be excluded by law; and
(j) relating to the conduct of the Competition however caused, including failure of the Northern Territory Web Site or incorrect or corrupt data supplied by Sportsbet to Registered Participant.
20. Information about Registered Participants is used by Sportsbet to assess and process registration in the Competition. If an applicant does not provide the required information, Sportsbet cannot process the registration. All entries become the property of Sportsbet and will be entered into a database. Information emanating from the Registered Participant's participation in the Competition is used by Sportsbet and its agencies associated with this Competition for the determination of winners and distribution of prizes, if any, awarded to a Registered Participant. Registered Participants consent to publishing their name or alias and accumulated winning team points in the results section of the Northern Territory Web Site. Sportsbet will not be held responsible for any loss of reputation, status or otherwise in connection with a Registered Participant's tipping selections and consequential results. It is a condition of entry that Registered Participants consent to these uses and disclosures of their information. Information about Registered Participants may also be used by Sportsbet, its agents, assignees, contractors and related companies, for the purposes of carrying out marketing, planning, product development and direct mail and promotional campaigns unless a Registered Participant otherwise withdraws their consent to the use of their information in this manner.
21. Notwithstanding Sportsbet's rights under condition 6 to not accept or to subsequently disqualify a Registered Participant or Group, Sportsbet will not be liable for any legal action arising out of any Group name being slanderous, defamatory or unsightly to the public at large or any similarly sounding or related group and any Registered Participant who uses a Group name which is subsequently found to be slanderous, defamatory or unsightly in any way will indemnify Sportsbet, its agents, assignees, contractors and related companies from any legal action, claim or dispute arising in relation thereto.
22. In the event there is a dispute or issue concerning or in any way arising out of or in relation to any aspect of the conduct, management or determination about the Competition, the decision of Sportsbet is final and no correspondence will be entered into.
23. In the event of any unclaimed prizes within three months, the prize will be allocated to the 2nd place winner, or the third place winner if the 2nd place winner is not available, and so on.
24. The conductor of the Competition is Sportsbet Pty Ltd, Level 1, 79-81 Smith Street, Darwin, 0800, Northern Territory, ABN 87 088 326 612.
25. All End of Season Prize winners will be notified by the Sportsbet Customers email and will be published on Sportsbet’s Northern Territory web site and in the Public Notices of The Australian Newspaper on the 1/10/08 and 24/09/08 for the NRL and AFL Code respectively.
26. The monetary prizes shall be deposited into the winner’s Sportsbet Customer Northern Territory Account as maintained by Sportsbet on behalf of its customers. Non-monetary prizes shall be distributed to the winner’s postal address by registered mail.
27. Any tax liability arising as a result of accepting any prize is the responsibility of the winner.
28. Sportsbet reserves the right to change, add or alter any of the terms and conditions (other than the prizes) if in the absolute opinion of Sportsbet it is in the interest of the Competition and such change shall be notified to the Registered Participants by being placed on Sportsbet’s website and each Registered Participant shall be bound by such change, addition or alteration to the Terms and Conditions of Entry.
29. These Terms and Conditions of Entry form the basis of an agreement made between Sportsbet and its Registered Participant which is made and entered into in the Northern Territory.
The published Rules are effective as at 1st February 2008.
